The Lowdown on Philadelphia Cannabis Laws

In 2016, Senate Bill 3 (passed as the Medical Marijuana Act 1) allowed for the use of medical cannabis to treat specific conditions, with the first medical marijuana purchases beginning in 2018. In 2017, the state began working on decriminalizing cannabis as a whole and continues to work towards legalization today. 

The city of Philadelphia created city-specific laws related to cannabis. In September 2014, the city council voted to decriminalize the use or possession of the drug up to 30 grams. 

Recreational Cannabis Laws in Philadelphia

Recreational use of cannabis in Philadelphia is illegal. Individuals who have up to 30 grams of tmarijuana on them may face a fine of up to $25 for doing so. Larger quantities have more significant fines—up to $10,000—and in some cases have associated jail time. It’s also illegal to sell, grow, or possess marijuana without a medical card. 

Medical Cannabis Laws in Philadelphia

Medical cannabis use is legal in Philadelphia, and is managed under the state’s Department of Health. Individuals must have a diagnosis that qualifies for medical marijuana, including:

  • Autism 

  • Anxiety disorders

  • Epilepsy

  • Huntington’s disease

  • Opioid use disorders 

  • Parkinson’s disease

  • Post-traumatic stress disorder

  • Terminal illness

  • Central nervous system disorders 

There are numerous other conditions that are eligible for coverage with doctor approval.

How to Get a Medical Marijuana Card in Philadelphia

To get a medical marijuana card, individuals must: 

  • Receive formal diagnosis from a state-approved doctor 

  • Receive a patient certification from their doctor that’s submitted to the Department of Health

  • Register on the Department of Health website

There’s a $50 fee to obtain a medical marijuana card. 

Where is it Legal to Consume Cannabis in Philadelphia

After visiting a dispensary, Philadelphia residents may be tempted to use their cannabis right away. However, the city does not allow public use of cannabis. That means an individual will need to use their medical marijuana at home and in private. The state laws do not outright ban the use of cannabis in public, but Philadelphia does not condone in public use.

How to Buy Cannabis at a Philadelphia Dispensary

There are a number of authorized marijuana dispensaries in Philadelphia. Operating hours are generally between 10am-5pm, though some dispensaries are open later. Some also both in-person shopping and delivery services. 

Cannabis Taxes in Philadelphia

The Medical Marijuana Program imposes a 5% excise tax on the gross receipts from the sale of cannabis in the city, which is paid by the grower or processor of the cannabis at the time of sales. However, medical marijuana is not otherwise subjected to sales tax in the city.
