Is it legal to fly with a weed pen?
If your weed pen contains recreational THC, federal law is where things get tricky. Federal aviation security rules and the federal Controlled Substances Act still apply when you fly, so the fact that weed is legal in your departure or destination state doesn't make recreational marijuana legal to take through airport security.
That means flying from one legal state to another doesn't create an exception. You might leave a state where you can legally buy cannabis and land in another where you can do the same, but that doesn't override federal law during air travel.

So, did anything change in 2026? The federal marijuana rescheduling process moved forward, but marijuana has not simply been given a federal green light.
On April 22, 2026, Acting Attorney General Todd Blanche terminated the previous rescheduling hearing and issued a new notice directing DEA to begin fresh proceedings. Formal hearings on the proposal to move marijuana from Schedule I to Schedule III began June 29. That process doesn't make recreational THC legal to carry through airport security. When it comes to packing the pen itself, the rule is straightforward: keep it in your carry-on or on you. The TSA electronic cigarettes and vaping devices rules prohibit vape devices in checked baggage.

The carry-on requirement is a battery-safety rule, not a cannabis rule. Vape pens use lithium batteries, which can pose a fire risk if they overheat or short-circuit. That's why the carry-on rule applies regardless of what type of legal material the device is designed to vaporize.
That battery rule comes with a couple of other requirements. Under the FAA PackSafe vaping device rules, lithium-ion batteries in vape devices can't exceed 100 watt-hours. Any spare batteries need to stay in your carry-on, too, with the terminals protected from short circuits.
If the airline asks you to check your carry-on at the gate, take the vape and any spare batteries out first. Your vape needs to stay with you rather than traveling in the cargo hold. The FAA lithium battery baggage guidance requires vaping devices to remain in the cabin.
All of that tells you where the device belongs. It doesn't change the rules for what's inside it. A vape may be allowed in your carry-on, but that doesn't make a recreational THC cartridge legal to fly with.
Does TSA check for weed vapes?
Despite what airport security might feel like when you're standing in line with your shoes off, TSA isn't actually looking for your weed.
The agency says its screening procedures are focused on security threats rather than searching for marijuana or other illegal drugs. But there's an important catch. If TSA discovers an illegal substance during security screening, its marijuana screening policy calls for the matter to be referred to law enforcement. From there, what happens depends on the responding authorities.

You may have also heard that airport scanners can tell whether there's THC inside a vape cart, but it's not that simple. TSA doesn't publicly detail every capability of its screening technology or provide travelers with a reliable way to know whether the contents of a particular cartridge can be identified during screening.
What we do know is that a vape can still get a closer look. If TSA discovers an illegal cannabis product during the screening process, the same referral policy applies.
Did TSA change its weed policy in 2026?
If you saw headlines saying TSA suddenly gave travelers the green light to fly with weed in 2026, there's more to the story.
TSA's guidance for medical marijuana lists the item as “Yes (Special Instructions),” but that isn't a blanket permission slip for cannabis. The special instructions matter more than the “Yes.”
Under TSA's current marijuana guidance, marijuana and certain cannabis-infused products remain illegal under federal law except for products that fall within the federal hemp exception or are approved by the FDA. TSA also says its officers are required to report suspected violations of law and refer illegal substances discovered during screening to law enforcement.

So what does that mean for your flight? TSA's website isn't saying recreational weed is fair game in your carry-on.
The agency may not be searching specifically for marijuana, but if an illegal cannabis product turns up during screening, TSA can still hand the matter over to law enforcement.
What about CBD and hemp vape pens?
CBD and hemp vapes play by a different set of rules than recreational THC carts. Under the 2018 Farm Bill hemp definition, hemp containing no more than 0.3% delta-9 THC by dry weight was removed from the federal definition of marijuana.
That doesn't mean every vape labeled “CBD” or “hemp” automatically gets the all-clear. What's actually in the product matters, and cannabis and hemp laws can vary once you reach your destination. Having the product's Certificate of Analysis (COA) handy can give you documentation of its cannabinoid content, but a COA doesn't override federal, state, airport, or airline rules.
And what qualifies as hemp is about to get narrower. Starting November 12, 2026, the federal hemp definition change will use a total THC standard that includes THCA when applying the 0.3% dry-weight limit. The new law makes other changes to the federal hemp definition as well, meaning some products that qualify as hemp under today's rules may not qualify after the new definition takes effect.
So if you're flying with CBD vape cartridges, checking the label is a start. Checking what's actually in the cart, and the rules where you're headed, is the better move.
How to pack a weed pen for a flight
If you're traveling with a vape device and contents that are legal to bring, a little prep before you zip up your bag can save you trouble at the airport.

Here's what to do:
- Keep the device in your carry-on. The vape and any spare lithium batteries need to stay with you in the cabin
- Check your batteries. Lithium-ion batteries in vaping devices can't exceed 100 watt-hours, and spares should be protected from short circuits
- Follow TSA's liquids rules. Any liquids you bring through the checkpoint need to comply with the TSA 3-1-1 liquids rule unless an exception applies
- Prevent accidental activation. Make sure the device can't turn itself on while it's tucked away in your bag
- Leave it off during the flight. Don't use or charge your vape onboard. The FAA vapes on a plane guidance prohibits using or charging electronic smoking devices aboard the aircraft
And remember the gate-check rule from earlier. If your carry-on ends up going into the cargo hold, take your vape and spare batteries out first.
Once you're onboard, the best place for your pen is exactly where you packed it. Leave it there until you land.
Can you fly internationally with a weed pen?
Taking a weed pen on an international flight is a different ballgame. Even if cannabis is legal where you're going, bringing it across the US border can still get you into trouble.
Under CBP marijuana border rules, crossing the US border with marijuana can lead to seizure, fines, arrest, and immigration or trusted-traveler consequences. And don't count on a small amount being too small to matter.
