It is legal to consume cannabis in the state of New Jersey; both medical and adult-use cannabis consumption are legal for adults. Medical marijuana use was legalized by the New Jersey Compassionate Use Medical Marijuana Act (CUMMA) or S 88 in January 2010. However, it wasn't until 2019 and the signing of bill A20, or Jake's Law, that allowed NJ weed delivery and other provisions to expand access to medical cannabis. New Jersey approved adult-over-21 cannabis use when Governor Phil Murphy signed the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (CREAMM Act) into law in February 2021. While the CREAMM Act legalized adult-use weed consumption, it did not include provisions that allow for adult-use weed delivery in NJ.Delivery of medical cannabis throughout the state of New Jersey is legal; however, the licensing for NJ adult-use weed delivery is still ongoing and is not yet available. As implementation of the law continues, legal adult-use weed delivery is one of the most pressing discussions throughout the state.

Is marijuana delivery legal in New Jersey?

NJ weed delivery is currently legal for medical marijuana use patients only. You must be a resident of New Jersey and registered in the Medical Marijuana Program (MMP) database to qualify.

What about adult-use marijuana delivery in New Jersey?

While adult-use marijuana is legal in the state, because it's so new, there are no processes in place to allow for legal adult-use weed delivery. However, as of September 2022, the New Jersey Cannabis Regulatory Commission (CRC) has proposed amendments to the existing state regulations that include licensing processes for delivery businesses. This proposal would even allow for cannabis delivery in municipalities that opted out of hosting dispensaries. With these proposed measures, it's possible that adult-use weed delivery becomes available in the near future.
