North Dakota Medical Marijuana Legalization Initiative, or North Dakota Measure 5, is a state-initiated statute on the November 8th, 2016 ballot to legalize medical marijuana in the state of North Dakota. The measure aimed to legalize cannabis to treat cancer, AIDs, PTSD, and other medical conditions. After failing to pass a similar measure in 2012, North Dakota approved Measure 5 with a 63.7% vote in favor, adding a new chapter to Title 19 of the North Dakota Century Code. In April 2017, the Governor Burgum signed SB 2344 into effect to clarify and modify the regulations set in motion by Measure 5.

 

All North Dakota Medical Marijuana qualifying patients and designated caregivers with Registry Identification Cards will be allowed to purchase 2.5 ounces every 30 days and possess up to 3 ounces of medical marijuana. A patient may only use combustible dry flower as authorized by a physician, and vaping is not restricted. The sale of edibles is prohibited.

 

Patients looking to join the North Dakota’s medical cannabis program and obtain a Registry Identification Card must apply with the North Dakota Department of Health by providing written physician’s certification, supporting application documents (name, address, date of birth, etc etc), and a personal check or cashier’s check to satisfy the non-refundable application fee of $50. After verifying application information, the Department of Health will approve or deny patient’s application within forty-five business days. Upon approval, the Department of Health will issue a registry identification card with a ten-digit alphanumeric identification within thirty calendar days. All registry identification cards will be valid for a full calendar year from issue date unless revoked.

 

Compassion Centers:

 

North Dakota Medical Marijuana Compassion Centers, or dispensaries, will operate with Department of Health issued certificates of registration and Compassion Centers shall not be located within one thousand feet of the property line of a preexisting public or private school. All compassion centers will properly implement security and safety measures to prevent the unauthorized entrance into the area.

 

Medical marijuana will be dispensed in sealed, tamper-proof containers with labels that clearly communicate the name of the strain, batch, quantity, and details indicating medical cannabis is free of contaminants. Marijuana should be contained in the container when it is not being consumed. Compassion centers cannot dispense more than 2.5 ounces of marijuana during a 30 day period. Every marijuana product must be barcode tracked from seed to final sale.

 

Compassion centers will provide patients with education on marijuana products and how to safely ingest medical marijuana, while also providing ingestion options for cannabis, safe smoking techniques, information on potential side effects, and other frequently asked questions.

 

Update 8/11/2017:

 

Only two (2) manufacturing facilities and eight (8) dispensaries will be licensed by the North Dakota Department of Health, for a total of ten (10) compassion centers. The DoH may add additional facilities if access to medical marijuana is insufficient. Organizations interested in being licensed as a manufacturing facility or dispensary were required to submit a letter of intent to apply no later than July 28, 2017.

accepted b4 applications are being accepted

Im glad to see that some1 had luck attempting to get accepted as a ligitimit compassionately care center b4 applications are being accepted. My advise to any1 waiting for ND to have the system running you will probably never see it in ur lifetime I hope you do but if you head west I guarantee u help.

I'm wondering when the doctors are going to get started in Fargo. I suffer from liver failure "cancer", hepatitis C, I don't take pain meds. I've been waiting patiently. Does anybody have any info?

The waiting game

I suffer from severe back trauma including stenosis. I also suffer from PTSD. I moved here from Texas. I can't wait to stop taking these pills and go back to what once provided me pain management.
