The Lowdown on Albuquerque Cannabis Laws

Cannabis is legal to use in Albuquerque, along with all of New Mexico, for both medical and recreational use. 

The state first approved medical use of cannabis in 2007, with the Lynn and Eric Compassionate Use Act. In 2018, Albuquerque decriminalized possession of up to 1 ounce of cannabis, ahead of the state’s decriminalization in 2019. In June of 2021, recreational use was finally approved through House Bill 2, also called the Cannabis Regulation Act.

Recreational cannabis use is legal in Albuquerque for adults age 21 and over. Users may possess and purchase up to 2 ounces of cannabis or 16 grams of extract, as well as up to 800 milligrams of edible cannabis per purchase. 

Medical Cannabis Laws in Albuquerque

Medical cannabis use is legal in Albuquerque for many conditions, including Alzheimer’s disease, autism spectrum disorder, cancer, opioid use disorder, seizures, and numerous others. This process is managed through the New Mexico Department of Health, and is available for patients under and over 21 years of age.

How to Get a Medical Marijuana Card in Albuquerque

To apply for a medical marijuana license through the Medical Cannabis Program, applications must provide:

  • A driver's license or ID with their application

  • A physician’s statement from a licensed medical professional

  • A completed application, available on the program’s website, part of which must also be completed by a medical provider 

Caregiver applications are also available. 

There is no fee for obtaining a medical marijuana card in New Mexico.

Where is it Legal to Consume Cannabis in Albuquerque

The recreational sale of cannabis is new to Albuquerque and the state. While it’s legal to purchase from a marijuana dispensary, Albuquerque residents still have to follow rules regarding the use of the product. Cannabis consumption is limited to private property. The city's laws also state that individuals must be out of public view when using cannabis. It cannot be used on public transportation, school campuses, workplaces, youth centers, recreation centers, or public parks. 

Additionally, driving under the influence remains illegal. As such, using cannabis in a vehicle is prohibited by law for both passengers and drivers. 

How to Buy Cannabis at an Albuquerque Dispensary

Those who wish to purchase cannabis can do so at one of the numerous locations throughout the city. Dispensary hours are generally from 10am-7pm,  with some offering curbside pickup and delivery. A state-issued ID card or a medical marijuana card is required in order to purchase cannabis. 

Cannabis Taxes in Albuquerque

New Mexico plans to end all taxes on cannabis products used for medical needs. There will be a new excise tax of 12% on the sale of recreational cannabis products, with revenue going to the state's general tax fund.
