1. General Statements
By accessing the WM DAM, you (“you” and, together with all other third-parties accessing the WM DAM, the “Users”) hereby agree to be legally bound by, and your access and use of the WM DAM and its content, images and other data shall be subject to, these terms and conditions (these “WM DAM Terms”), as well as the Weedmaps' Terms of Service (the “WM Terms”) and the Weedmaps’ Privacy Policy (the “WM Privacy Policy” and, together with the WM Terms and the WM Dam Terms, the “Terms”).
Please be sure to carefully read these WM DAM Terms, as well as the other Terms, as they contain important information regarding your legal rights, remedies and obligations.
2. License and Grant of Access
All images appearing on the WM DAM are and shall remain the exclusive property of Ghost Management Group, LLC (“Weedmaps”, “we” or “us”). Subject to the Terms, we hereby grant to you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right and license to (i) download the images for which you have been specifically granted access on the WM DAM by way of a hyperlink appearing in an email sent to you by or on our behalf (the “Specified Images”), and (ii) display such Specified Images only on your business’ own website and/or on your business’ social media accounts (e.g., Facebook, Instagram & Twitter) (collectively, the “Permitted Uses”). You hereby acknowledge and agree that this license does not extend to the use of the Specified Images in any manner other than the Permitted Uses set forth above.
3. Watermarking
Certain of the Specified Images downloaded from the WM DAM may contain a Weedmaps or other watermark (the “Watermark”), as determined by Weedmaps in its sole discretion. You hereby acknowledge and agree that (i) you shall not remove, obscure or otherwise alter any Watermark displayed on any of the Specified Images, and (ii) the Watermark shall remain visible on the Specified Images at all times and in such manner as such Watermark was originally placed on such Specified Images by Weedmaps.
Please note that a failure by you to comply with these WM DAM Terms or any of the other Terms may result in, among other things, the loss of access to the WM DAM and/or the revocation of any licenses granted herein, and Weedmaps hereby reserves all rights it may have under the Terms and applicable law in connection with any such non-compliance.
