ACH Checkout Terms

By using the Weedmaps Products and/or Services for WM Orders where the ACH Checkout Feature is enabled, you agree to be bound by the Weedmaps Consumer Terms of Use as well as these ACH Checkout Terms, the Weedmaps Privacy Policy, and any other terms or agreements applicable to you, collectively, the Agreement between you and us in connection with your access to and use of the Services. Capitalized terms used within these ACH Checkout Terms but not defined herein will have the meanings given to them elsewhere in the Consumer Terms of Use.

As part of our Services, when you use WM Orders, Weedmaps may also make a feature available which gives you the ability to use an account with a third-party ACH payments provider in order to directly pay participating Businesses for your order (the “ACH Checkout Feature”).

1. Use of the ACH Checkout Feature

By using the ACH Checkout Feature, you acknowledge and agree that Weedmaps has no role or responsibility in the transaction fulfillment or payment process, and that your payment and transaction is made directly between you and the participating Business, and not with Weedmaps. Weedmaps is not a financial institution, does not provide electronic fund transfer services or payment services of any kind, has no involvement in the flow of funds or the exchange of goods between you and the Business, and is not responsible for issues with the items you order or for issues with your payment. If you have an issue with your purchase or payment, you must contact the Business, the ACH payments provider, and/or your bank to resolve it, as described further below.

2. ACH Payment Provider's Role

Aeropay provides the ACH payment service and is responsible for all aspects of it, including compliance with applicable laws and NACHA operating rules, and with providing customer support for your Aeropay account. All activity with your Aeropay account in connection with the ACH Checkout Feature is subject to the Aeropay Terms of Service (the “Aeropay Terms”). Review all terms carefully before using the ACH Checkout Feature.

3. Estimated Totals, Taxes, and Promotions

When you place an order and pay a participating Business using your Aeropay account via the ACH Checkout Feature, you understand and acknowledge that Weedmaps is only providing you with an estimated total for the transaction based on information available at the time. The final transaction total is subject to change, including due to changes to your order, changes to tax amounts, or if the Business determines that you’re not eligible for a particular promotion.

4. Payment Completion

You understand that when you use the ACH Checkout Feature, the payment is not completed until the Business completes the transaction via the Business’s own payment interface with the third-party ACH payments service at the time of order fulfillment, and that the Business will complete the payment for the final transaction total, which may be different than the estimated total displayed during checkout. Final transaction information will be available on the receipt provided to you by the Business once your order is fulfilled.

5. Security of your ACH Payment Provider Login Credentials

You may be asked to enter your Aeropay account login credentials, including email and password, or to verify your identity via another form of authentication with Aeropay, before you’re able to initiate transactions using your Aeropay account via the ACH Checkout Feature. You agree to keep your Aeropay login credentials secure and not to share them with anyone.

6. Returns and Refunds

You understand and agree that returns and refunds are subject to each Business's own terms and policies for your purchase. Businesses should provide their return and refund policies to you before completing your transaction, and you can also contact the Business directly to request these prior to placing your order.

7. Order and Payment Cancellations

You understand and agree that once you initiate a payment via the ACH Checkout feature, you must contact the Business directly in order to request to cancel your order or your ACH payment, and that Weedmaps is unable to reverse or cancel orders or payments after they have been initiated by you.

8. Support

a. If you have issues with your order or with the items you purchased, including situations where you received incorrect items or have missing items, you should contact the Business directly.

b. If you need to dispute a payment, you can contact your bank directly, or you can contact Aeropay and it will be handled in accordance with their dispute resolution procedures.

You understand and acknowledge that Weedmaps has no responsibility for and is unable to assist with payment-related issues or disputes.

9. Termination or Suspension of Access

Your access to the ACH Checkout Feature may be suspended or terminated in Weedmaps’ sole discretion, including in the event of misuse, fraud or abuse in connection with your use of the ACH Checkout Feature.

10. Release of Liability

In the event that you have any issue with a transaction, payment, or purchase made in connection the ACH Checkout Feature, including a dispute with a Business, with Aeropay, or any other third-party, you agree to release Weedmaps (and our agents, affiliates, directors, officers and employees) from all claims, demands, actions, proceedings, costs, expenses and damages (including without limitation any actual, special, incidental or consequential damages) arising out of or in connection with such issue, dispute, payment, purchase, or transaction.
