Vape pens use lithium batteries, which can pose a fire risk if they overheat or short-circuit. That's why the carry-on rule applies regardless of what type of legal material the device is designed to vaporize.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That battery rule comes with a couple of other requirements. Under the <a href=\"https:\/\/www.faa.gov\/hazmat\/packsafe\/e-cigarettes-vaping\">FAA PackSafe vaping device rules<\/a>, lithium-ion batteries in vape devices can't exceed 100 watt-hours. Any spare batteries need to stay in your carry-on, too, with the terminals protected from short circuits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the airline asks you to check your carry-on at the gate, take the vape and any spare batteries out first. Your vape needs to stay with you rather than traveling in the cargo hold. The <a href=\"https:\/\/www.faa.gov\/newsroom\/lithium-batteries-baggage\">FAA lithium battery baggage guidance<\/a> requires vaping devices to remain in the cabin.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All of that tells you where the device belongs. It doesn't change the rules for what's inside it. A vape may be allowed in your carry-on, but that doesn't make a recreational THC cartridge legal to fly with.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"does-tsa-check-for-weed-vapes\">\n\tDoes TSA check for weed vapes?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Despite what airport security might feel like when you're standing in line with your shoes off, TSA isn't actually looking for your weed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The agency says its screening procedures are focused on security threats rather than searching for marijuana or other illegal drugs. But there's an important catch. If TSA discovers an illegal substance during security screening, its <a href=\"https:\/\/www.tsa.gov\/travel\/security-screening\/whatcanibring\/all-list\">marijuana screening policy<\/a> calls for the matter to be referred to law enforcement. TSA doesn't publicly detail every capability of its screening technology or provide travelers with a reliable way to know whether the contents of a particular cartridge can be identified during screening.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What we do know is that a vape can still get a closer look. If TSA discovers an illegal cannabis product during the screening process, the same referral policy applies.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"did-tsa-change-its-weed-policy-in-2026\">\n\tDid TSA change its weed policy in 2026?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you saw headlines saying TSA suddenly gave travelers the green light to fly with weed in 2026, there's more to the story.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">TSA's guidance for medical marijuana lists the item as \u201cYes (Special Instructions),\u201d but that isn't a blanket permission slip for cannabis. The special instructions matter more than the \u201cYes.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under TSA's <a href=\"https:\/\/www.tsa.gov\/travel\/security-screening\/whatcanibring\/all-list\">current marijuana guidance<\/a>, marijuana and certain cannabis-infused products remain illegal under federal law except for products that fall within the federal hemp exception or are approved by the FDA. Under the <a href=\"https:\/\/www.fda.gov\/news-events\/congressional-testimony\/hemp-production-and-2018-farm-bill-07252019\">2018 Farm Bill hemp definition<\/a>, hemp containing no more than 0.3% delta-9 THC by dry weight was removed from the federal definition of marijuana.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That doesn't mean every vape labeled \u201cCBD\u201d or \u201chemp\u201d automatically gets the all-clear. What's actually in the product matters, and cannabis and hemp laws can vary once you reach your destination. The new law makes other changes to the federal hemp definition as well, meaning some products that qualify as hemp under today's rules may not qualify after the new definition takes effect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So if you're flying with CBD vape cartridges, checking the label is a start. Those rules vary widely, and something that's perfectly legal back home may be treated very differently after you land.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The safer move is an easy one here: leave the weed pen at home and check the local laws before buying or consuming cannabis at your destination.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"airline-and-airport-rules\">\n\tAirline and airport rules<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The rules can stack up fast when you're flying with a vape. TSA and FAA rules aren't the only ones that matter.
