As a result, <a href=\"https:\/\/www.dshs.texas.gov\/consumerprotection\/hemp-program\/default.aspx\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">licensed retailers may sell some hemp products<\/a> with CBD if they also contain the THC within the legal limit. The state allows patients with certain qualifying conditions to use other medical formulations that contain CBD, and new conditions are currently under review.&nbsp;<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"what-is-cbd\">\n\tWhat is CBD?<\/h2>\n\n\n\n<p>CBD stands for cannabidiol. It is a non-intoxicating <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/weedmaps.com\/learn\/dictionary\/cannabinoid\/\" target=\"_blank\">cannabinoid<\/a> found in cannabis. Cannabidiol is the second-most abundant cannabinoid in the plant after <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/weedmaps.com\/learn\/dictionary\/tetrahydrocannabinol-thc\/\" target=\"_blank\">tetrahydrocannabinol<\/a> (THC). It has many potential therapeutic benefits, including anti-inflammatory, analgesic, anti-anxiety, and seizure-suppressant properties. The legislation swept all cannabis into the Schedule I category, which defined cannabis as a substance with a high potential for abuse, no accepted medical use, and a likelihood for addiction.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/house-bill\/5485\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Hemp Farming Act of 2018<\/a> legalized hemp cultivation and created a legal distinction between hemp and marijuana. Hemp is cannabis that contains less than .3% THC by weight, and marijuana contains more than .3% THC. Hemp-derived CBD was thus descheduled by the bill, but CBD that is derived from marijuana, still a Schedule I substance, is considered federally illegal. While hemp is now considered an agricultural commodity, it must be produced and sold under regulations that implement the bill. The USDA has yet to create these <a href=\"https:\/\/www.brookings.edu\/blog\/fixgov\/2018\/12\/14\/the-farm-bill-hemp-and-cbd-explainer\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">regulations<\/a>.&nbsp;<\/p>\n\n\n\n<p>The Farm Bill also preserved the power of the Food and Drug Administration (FDA) to regulate CBD's labeling, therapeutic claims, and its use as a food additive.&nbsp; The FDA maintains that even hemp-derived CBD may not be added to food and beverages, nor marketed as dietary supplements. The FDA has begun a process of reevaluating its position on such CBD products, but it has yet to revise its rules or specifically regulate CBD products, leading to further confusion. The FDA has been strict when it comes to claims that could be construed as medical advice about CBD.<\/p>\n\n\n\n<p>The federal government still highly regulates the production and sale of hemp, and its cannabinoids, including CBD. The Farm Bill allows for states to regulate or even prohibit CBD cultivation and commerce. In addition, states may attempt to regulate CBD food, beverage, dietary supplement, and cosmetic products, independently of the FDA finalizing its views on such products.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"texas-cbd-laws\">\n\tTexas CBD laws<\/h2>\n\n\n\n<p>The Texas Department of State Health Services formally removed CBD from the Schedule I <a href=\"https:\/\/www.dallasnews.com\/news\/politics\/2019\/04\/01\/texas-debates-hemp-bills-as-state-takes-it-off-list-of-dangerous-drugs-how-might-marijuana-cbd-laws-change\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">controlled substances list <\/a>on April 5, 2019, following the adoption of the <a href=\"https:\/\/news.weedmaps.com\/2018\/12\/trump-signs-farm-bill-making-industrial-hemp-legal-again\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">2018 Hemp Farming Bill, which federally removed CBD<\/a> from the category.&nbsp;<\/p>\n\n\n\n<p>On June 10, 2019, Republican Gov. Greg Abbott signed <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/capitol.texas.gov\/tlodocs\/86R\/billtext\/pdf\/HB01325F.pdf#navpanes=0\" target=\"_blank\">House Bill 1325<\/a>, which established broad regulations for hemp production, cultivation, and testing. The <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.dps.texas.gov\/rsd\/CUP\/index.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Texas Compassionate Use Act<\/a> legalized CBD with .5% THC or less for patients with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Autism;<\/li>\n\n\n\n<li>Amyotrophic lateral sclerosis (ALS), or Lou Gehrig's disease;<\/li>\n\n\n\n<li>Incurable neurodegenerative disorders;<\/li>\n\n\n\n<li>Intractable epilepsy;<\/li>\n\n\n\n<li>Spasticity;<\/li>\n\n\n\n<li>Multiple sclerosis;<\/li>\n\n\n\n<li>Seizure disorders;<\/li>\n\n\n\n<li>Terminal cancer.<\/li>\n<\/ul>\n\n\n\n<p>When the <a href=\"https:\/\/www.dps.texas.gov\/rsd\/CUP\/index.htm\">Texas Health and Hu<\/a><a rel=\"noreferrer noopener\" aria-label=\"m (opens in a new tab)\" href=\"https:\/\/www.dps.texas.gov\/rsd\/CUP\/index.htm\" target=\"_blank\">man Services Commission <\/a>adopts rules on the qualifying diseases, more incurable neurodegenerative disorders may be added to the list.<\/p>\n\n\n\n<p>The only FDA-approved of CBD by the is GW <a href=\"https:\/\/news.weedmaps.com\/2019\/05\/whole-plant-cbd-oil-epidiolex-epilepsy-reduce-seizures\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Pharmaceuticals' Epidiolex<\/a>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Licensing requirements for CBD <\/h2>\n\n\n\n<p>Patients with qualifying conditions may apply for a medical CBD card though the <a href=\"https:\/\/www.dps.texas.gov\/rsd\/CUP\/index.htm#patients\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Texas Compassionate Use Program<\/a>.<\/p>\n\n\n\n<p>The Texas Department of Agriculture (TDA) approved the proposed <a href=\"https:\/\/www.texasagriculture.gov\/Portals\/0\/forms\/COMM\/Hemp\/TDA_State_Hemp_Plan_FINAL.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">State Hemp Plan<\/a> in January 2020, and the <a href=\"https:\/\/texreg.sos.state.tx.us\/public\/readtac$ext.ViewTAC?tac_view=4&amp;ti=4&amp;pt=1&amp;ch=24\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">rules and regulations<\/a> for the cultivation and licensing of hemp growers, processors, and manufacturers have been added to the Texas Administrative Code.&nbsp;<\/p>\n\n\n\n<p>Applications to produce hemp are available on the <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/licensing.texasagriculture.gov\/\" target=\"_blank\">Texas Department of Agriculture website<\/a>, and potential applicants are encouraged to contact their <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.texasagriculture.gov\/About\/RegionalOperations.aspx\" target=\"_blank\">TDA regional office<\/a>.&nbsp;<\/p>\n\n\n\n<p>Texas' definition of <a href=\"https:\/\/www.dshs.texas.gov\/consumerprotection\/hemp-program\/default.aspx\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">consumable hemp products<\/a> includes foods, drugs, devices or cosmetics that contain industrial hemp or hemp-derived cannabinoids, including CBD, with no more than 0.3% THC. The Texas Department of State Health Services (DSHS) is creating a registration process for retailers to sell consumable hemp products with CBD.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Texas CBD possession limits<\/h2>\n\n\n\n<p>Possession of <a href=\"https:\/\/weedmaps.com\/learn\/the-plant\/understanding-the-medicinal-benefits-of-cbd-thca-in-texas\">CBD is legal in Texas<\/a>, as long as it falls under the .3% THC threshold. The Texas CBD medical program allows CBD with .5% THC for patients with a medical card.<\/p>\n\n\n\n<p>If a patient has CBD that contains more than .3% THC, they could face felony charges for possession of cannabis or THC oil. A conviction carries a sentence of&nbsp; 180 days to two years and a $10,000 fine.
