Previously, they were only allowed to sell pre-packaged goods.<\/p>\n\n\n\n<p>The legislation, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB1775\">AB 1775<\/a>, effectively legalizes weed-smoking restaurants and Amsterdam-style cannabis cafes in cities that decide to allow them. These businesses will also be able to host live music and performances. Cities must authorize licensed cannabis businesses to operate as consumption lounges before they can begin offering these new services.<\/p>\n\n\n\n<p>Several cities in California, including <a href=\"https:\/\/www.sf.gov\/get-permit-open-cannabis-lounge\">San Francisco<\/a>, <a href=\"https:\/\/www.weho.org\/business\/cannabis\">West Hollywood<\/a>, and <a href=\"https:\/\/records.cityofsacramento.org\/ViewDoc.aspx?ID=s6tFBnt4W+L6vQfd8sihoV4wU3ELi80Z\">Sacramento<\/a>, have approved or are in the process of authorizing cannabis lounges.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Where is cannabis consumption prohibited in California?<\/h3>\n\n\n\n<p>The use of cannabis is generally illegal anywhere that it's illegal to smoke tobacco.&nbsp;<\/p>\n\n\n\n<p>Smoking within 1,000 feet of a school, daycare center, or youth center while children are present is also prohibited. Property owners can ban cannabis use on their property, so check for restrictions if you're a tenant or a guest.&nbsp;<\/p>\n\n\n\n<p>Because weed remains illegal under federal law (for now), consumption is also prohibited on federal lands, like national parks.<\/p>\n\n\n\n<p>It's illegal to have an open container of weed while driving or riding in a vehicle. You can transport weed in a car, but it must be in the trunk or a sealed package or container.<\/p>\n\n\n\n<p>It is a <a href=\"https:\/\/www.ots.ca.gov\/media-and-research\/campaigns\/drugged-driving\/\">crime<\/a> to drive under the influence of weed \u2014 yes, even if it's medicinal. It's also illegal to transport cannabis across state lines, even when traveling to another legal state.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"growing-cannabis-in-california\">\n\tGrowing cannabis in California<\/h2>\n\n\n\n<p>For personal use, adults in California can grow up to six cannabis plants at home.&nbsp;<\/p>\n\n\n\n<p>The plants must not be visible to the public, and if the grower is a tenant, the property owner must approve of the cultivation.&nbsp;<\/p>\n\n\n\n<p>You don't need a state-issued license when growing six plants or less for personal use. However, cities and counties can prohibit or restrict outdoor personal cultivation in other ways, so be sure to check local regulations before starting your grow.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"medical-marijuana-in-california\">\n\tMedical marijuana in California<\/h2>\n\n\n\n<p>The State of California's <a href=\"https:\/\/cannabis.ca.gov\/consumers\/medicinal-cannabis\/\">Medical Marijuana Identification Card Program<\/a> (MMICP) grants cardholders the ability to access cannabis without certain restrictions that apply to recreational marijuana users.&nbsp;<\/p>\n\n\n\n<p>Medical users are <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/CHSI\/Pages\/MMICP-FAQs.aspx#How%20does%20Proposition%2064%20affect%20patients%20who%20use%20medical%20cannabis?\">not required<\/a> to pay sales tax on cannabis purchases (excise and local business taxes still apply). The state <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/CHSI\/Pages\/MMICP-FAQs.aspx#How%20much%20medical%20marijuana%20can%20I%20have%20in%20my%20possession?\">allows<\/a> medical users to purchase and possess up to 8 ounces of cannabis flower per day, rather than just 1 ounce, and cultivate up to six mature or 12 immature marijuana plants, barring local restrictions.<\/p>\n\n\n\n<p>To get a medical marijuana card, California residents must receive a physician's recommendation and then submit a copy of this recommendation, proof of identity, and proof of residence to their county's <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/CHSI\/Pages\/County-Program-and-Hours.aspx\">applicable health agency<\/a>.&nbsp;<\/p>\n\n\n\n<p>County programs will take a patient's photograph and charge up to $100 for application or renewal. Medi-Cal beneficiaries and indigent patients may receive a fee reduction or waiver.<\/p>\n\n\n\n<p>Qualifying conditions under California's medical marijuana program:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>AIDS<\/li>\n\n\n\n<li>Anorexia<\/li>\n\n\n\n<li>Arthritis<\/li>\n\n\n\n<li>Cachexia (wasting syndrome)<\/li>\n\n\n\n<li>Cancer<\/li>\n\n\n\n<li>Chronic pain<\/li>\n\n\n\n<li>Glaucoma<\/li>\n\n\n\n<li>Migraine<\/li>\n\n\n\n<li>Persistent muscle spasms (like those associated with multiple sclerosis)<\/li>\n\n\n\n<li>Seizures<\/li>\n\n\n\n<li>Severe nausea<\/li>\n<\/ul>\n\n\n\n<p>The California Department of Public Health also <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/CHSI\/Pages\/MMICP-FAQs.aspx#What%20serious%20medical%20condition(s)%20do%20I%20need%20to%20have%20to%20qualify%20for%20a%20MMIC\">cites<\/a> \u201cany other chronic or persistent medical symptom that either substantially limits a person's ability to conduct one or more&nbsp;of major life activities as defined in the federal Americans with Disabilities Act of 1990, or if not alleviated, may cause serious harm to the person's safety, physical, or mental health.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">California medical marijuana caregiver rules<\/h3>\n\n\n\n<p>California residents who have a <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/CHSI\/Pages\/MMICP-Roles-and-Responsibilities.aspx\">primary caregiver<\/a>, whether a family member or otherwise, must apply for a medical marijuana card with their caregiver present.<\/p>\n\n\n\n<p>A caregiver cannot apply for a medical marijuana card for themselves or on behalf of their patient. As part of the application or renewal process, caregivers must provide proof of identity, be photographed, and sign the caregiver declaration portion of the application form.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"legal-history-and-framework\">\n\tLegal history and framework<\/h2>\n\n\n\n<p><strong>1996<\/strong>: California leads medical legalization in the U.S.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>California voters pass <a href=\"https:\/\/ballotpedia.org\/California_Proposition_215,_Medical_Marijuana_Initiative_(1996)\">Proposition 215<\/a>,
