{"id":3346,"date":"2019-06-21T03:13:42","date_gmt":"2019-06-21T03:13:42","guid":{"rendered":"https:\/\/weedmaps.com\/learn\/laws-and-regulations\/south-korea"},"modified":"2024-08-20T13:36:02","modified_gmt":"2024-08-20T13:36:02","slug":"south-korea","status":"publish","type":"law","link":"https:\/\/weedmaps.com\/learn\/laws-and-regulations\/south-korea","title":{"rendered":"South Korea"},"content":{"rendered":"<div id=\"bsf_rt_marker\"><\/div>\n<h2 class=\"wm-article-table-of-contents-header\" id=\"legislation-history\">\n\tLegislation history<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">On Nov. 23, 2018, South Korea became the first East Asian country to legalize cannabis-based medical products, albeit with heavy regulation.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The South Korean National Assembly approved <\/span><a href=\"https:\/\/likms.assembly.go.kr\/bill\/billDetail.do?billId=PRC_V1E8A0T9Q1Z9I1H7H1U4E0Z9P6X1Z4&amp;ageFrom=20&amp;ageTo=20\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">amendments<\/span><\/a><span style=\"font-weight: 400\"> to the <\/span><a href=\"https:\/\/elaw.klri.re.kr\/eng_service\/lawView.do?hseq=37716&amp;lang=ENG\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Narcotic Drug Management Act<\/span><\/a><span style=\"font-weight: 400\"> to allow patients with diseases documented to be alleviated through the use of medical cannabis to have legal access to a few cannabis products. The decision reversed decades of strict prohibitions and heavy sentences against cannabis use. <\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">South Korea criminalized cannabis along with poppies, opium, and cocaine in 1957, although at the time the ban applied only to Indian-grown marijuana, allowing the Korean market of cannabis to grow. In the 1960s, cannabis use rose. <\/span><span style=\"font-weight: 400\">The government <\/span><span style=\"font-weight: 400\">began cracking down on smokers in the 1970s. In 1976, the <\/span><a href=\"https:\/\/elaw.klri.re.kr\/kor_service\/lawView.do?lang=ENG&amp;hseq=7625\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Cannabis Control Act<\/span><\/a><span style=\"font-weight: 400\"> singled out marijuana and outlawed smoking and possession of all cannabis.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Since then, attempts to reform the drug laws have fallen short. However, in January 2018, Shin Chang-hyun, of the Democratic Party, <\/span><a href=\"https:\/\/www.koreabiomed.com\/news\/articleView.html?idxno=2504\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">introduced the new legislation.<\/span><\/a><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">In part, the translated <\/span><a href=\"https:\/\/likms.assembly.go.kr\/bill\/billDetail.do?billId=PRC_V1E8A0T9Q1Z9I1H7H1U4E0Z9P6X1Z4\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">revision<\/span><\/a><span style=\"font-weight: 400\"> said that while it is necessary to regulate the hallucinogenic and addictive effects of hemp, certain medicinal use should be considered to be allowed.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"medical-cannabis\">\n\tMedical cannabis<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">A few cannabis products are now legal.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The only qualifying conditions as of March 2019 are two forms of epilepsy: Lennox-Gastaut and Dravet syndromes. The only currently allowed product was <\/span><a href=\"https:\/\/www.epidiolex.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Epidiolex<\/span><\/a><span style=\"font-weight: 400\">, an FDA-approved cannabidiol.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">However, the Ministry of Food and Drug Safety said in July 2018 it would permit Epidiolex, <\/span><a href=\"https:\/\/marinol.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Marinol<\/span><\/a><span style=\"font-weight: 400\">, and <\/span><a href=\"https:\/\/www.webmd.com\/drug-not-available\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Cesamet<\/span><\/a><span style=\"font-weight: 400\"> for weight loss or nausea from HIV\/AIDS and cancer-related treatments, and <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Sativex\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Sativex<\/span><\/a><span style=\"font-weight: 400\"> for symptoms of multiple sclerosis.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Patients must apply to the government with a doctor's prescription, medical records, and a qualifying condition to be approved by the government on a case-by-case basis. Then they may order online through the <\/span><a href=\"https:\/\/www.kodc.or.kr\/eng\/index.do?menuId=1\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Korea Orphan Drug Center,<\/span><\/a><span style=\"font-weight: 400\"> a government organization that arranges access to rare medicines. The medicine must be picked up at the center's offices in Seoul. Those outside the region must travel. <\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"adult-use-cannabis\">\n\tAdult-use cannabis <\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">South Korea has a history of strict laws and enforcement of marijuana offenses and has no provisions to allow adult-use cannabis. Smokers can face five years in prison and fines of more than $40,000, or more than $50 million won. The government has said it will arrest citizens for <\/span><a href=\"https:\/\/www.theguardian.com\/world\/2018\/oct\/23\/bong-arm-of-the-law-south-korea-says-it-will-arrest-citizens-who-smoke-weed-in-canada\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">using marijuana in Canada<\/span><\/a><span style=\"font-weight: 400\"> and other places where recreational cannabis is legal.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Nov. 23, 2018, South Korea became the first East Asian country to legalize cannabis-based medical products, albeit with heavy regulation.
