Hemp-derived CBD oil with less than 0.3% THC is the only form of cannabis that's permitted.&nbsp;<\/span><\/p>\n\n\n\n<p><a href=\"https:\/\/iga.in.gov\/legislative\/laws\/2020\/ic\/titles\/035#35-48-4-11\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Possession of less than 30 grams<\/span><\/a><span style=\"font-weight: 400\"> of marijuana or less than 5 grams of hash is a class A misdemeanor with a penalty of up to one year imprisonment and a fine of up to $5,000. <\/span><a href=\"https:\/\/iga.in.gov\/legislative\/laws\/2020\/ic\/titles\/035#35-50-2-7\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Possession of more<\/span><\/a><span style=\"font-weight: 400\"> or subsequent offenses is a class D felony, which can earn violators between six months and 2.5 years in prison as well as a fine up to $10,000.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legislation history<\/strong><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">In 1913, Indiana became one of the first states to <\/span><a href=\"https:\/\/www.canorml.org\/the-origins-of-californias-1913-cannabis-law\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">ban the sale of marijuana<\/span><\/a><span style=\"font-weight: 400\"> without a prescription. After Harry Anslinger helped pass the Marihuana Tax Act in 1937, it wasn't long before the historically conservative Indiana adopted some of the <\/span><a href=\"https:\/\/www.indianapolismonthly.com\/features\/the-beat-cbd-oil\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">strictest cannabis laws<\/span><\/a><span style=\"font-weight: 400\"> in the United States.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Efforts to change legislation began in early 2013, though these efforts found little success. In February 2013, a bill to decriminalize small amounts of marijuana was killed in committee.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">In early 2015, bills were introduced both in the House (<\/span><a href=\"https:\/\/iga.in.gov\/legislative\/2015\/bills\/house\/1487\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">HB 1487<\/span><\/a><span style=\"font-weight: 400\">) and Senate (<\/span><a href=\"https:\/\/iga.in.gov\/legislative\/2015\/bills\/senate\/284\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">SB 284<\/span><\/a><span style=\"font-weight: 400\">) to legalize medical marijuana for certain qualifying conditions with a physician's recommendation. The House Bill failed to advance, and the Senate bill died before receiving a hearing.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Four years later in April 2017, Gov. Eric Holcomb signed <\/span><a href=\"https:\/\/iga.in.gov\/legislative\/2017\/bills\/house\/1148\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">HB 1148<\/span><\/a><span style=\"font-weight: 400\"> to allow the use of CBD oil containing less than 0.3% THC for patients with uncontrollable seizures whose symptoms were resistant to traditional treatments. While HB 1148 legalized hemp-derived CBD, it didn't specify a way for patients to purchase it.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The vagueness in HB 1148 made way for a new law that broadened access to CBD and specified regulations surrounding its sale. In March 2018, Holcomb signed <\/span><a href=\"https:\/\/iga.in.gov\/legislative\/2018\/bills\/senate\/52#document-6a10d137\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">SB 52<\/span><\/a><span style=\"font-weight: 400\"> to allow the use and sale of CBD for any purpose, so long as it contained less than 0.3% THC by weight. The law also imposed additional requirements for testing and labeling. SB 52 took effect July 1, 2018.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>FAQ<\/strong><\/h2>\n\n\n\n<p><b>When will medical marijuana be legal in Indiana?<\/b><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Typically, that is up to the state's residents, governor, and legislators. In an <\/span><a href=\"https:\/\/www.chicagotribune.com\/marijuana\/sns-indiana-path-marijuana-legalization-20200310-il5p33zavnhpxmiaibgeqiprk4-story.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">interview with the Chicago Tribune<\/span><\/a><span style=\"font-weight: 400\"> in March of 2020, State Rep. Mike Karickhoff (R-Kokomo) said cannabis is \u201cstill illegal federally, and Gov.
