Weed Laws"},"content":{"rendered":"<div id=\"bsf_rt_marker\"><\/div>\n<h2 class=\"wm-article-table-of-contents-header\" id=\"is-weed-legal-in-washington-d-c\">\n\tIs weed legal in Washington, D.C.?<\/h2>\n\n\n\n<p>Medical marijuana is legal, and <a href=\"https:\/\/code.dccouncil.gov\/us\/dc\/council\/code\/sections\/48-904.01#\">adults 21 and older may legally possess and consume small amounts of recreational cannabis<\/a>, but recreational dispensaries are not allowed.&nbsp;<\/p>\n\n\n\n<p>In other words, you can legally use cannabis in the District of Columbia, but you cannot buy it from a dispensary unless you're a registered medical marijuana patient.&nbsp;<\/p>\n\n\n\n<p>A federal budget restriction known as the <a href=\"https:\/\/www.congress.gov\/crs-product\/LSB11188\">Harris Rider<\/a> has prevented Washington from regulating adult-use sales since 2015. Instead, the district operates a robust <a href=\"https:\/\/abca.dc.gov\/page\/medical-cannabis-program#gsc.tab=0\">medical cannabis program<\/a>, which has expanded significantly in recent years to serve both patients and everyday users through medical dispensaries.<\/p>\n\n\n\n<p><a href=\"https:\/\/weedmaps.com\/doctors\/in\/united-states\/district-of-columbia\/washington\">Find Washington medical marijuana doctors<\/a> and <a href=\"https:\/\/weedmaps.com\/dispensaries\/in\/united-states\/dc\">dispensaries<\/a>, or order <a href=\"https:\/\/weedmaps.com\/deliveries\/in\/united-states\/DC\">medical weed delivery<\/a> from local retailers on Weedmaps.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"whats-new\">\n\tWhat&#039;s new<\/h2>\n\n\n\n<p>In 2025, District of Columbia authorities ramped up crackdowns on unlicensed \u201cgifting\u201d shops, <a href=\"https:\/\/abca.dc.gov\/release\/abca-mpd-padlock-50th-illegal-cannabis-shop#\">shutting down over 50 illegal sellers through April 2025<\/a>. The district also expanded its medical program, increasing individual purchase limits from four to <a href=\"https:\/\/abca.dc.gov\/service\/find-medical-cannabis-retailer#\">eight ounces per month<\/a> of dried medical cannabis.&nbsp;<\/p>\n\n\n\n<p>Dozens of <a href=\"https:\/\/www.youtube.com\/watch?v=o7f1wF_Fptk\">new dispensaries have also opened<\/a>, and new policies <a href=\"https:\/\/abca.dc.gov\/page\/patients%E2%80%94dc-residents\">allowing any adult 21 and older to \u201cself-certify\u201d as a medical user<\/a> make getting a medical card significantly easier than before.<\/p>\n\n\n\n<p>However, Congress continues to renew the Harris Rider each year, so Washington cannot enact an independent and regulated recreational sales system. The only legal retail access to cannabis in the district remains through medical weed dispensaries.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"quick-facts-washington-d-c-cannabis-laws\">\n\tQuick facts: Washington, D.C. cannabis laws<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Legal status<\/h3>\n\n\n\n<p>Medical cannabis is legal.&nbsp;<\/p>\n\n\n\n<p>Adult recreational consumption, possession, and home cultivation are legal, but a Washington-specific federal mandate has prohibited recreational sales.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Purchase limits<\/h3>\n\n\n\n<p>Purchasing weed in Washington is only possible through licensed medical dispensaries. The district does not allow recreational cannabis dispensaries.<\/p>\n\n\n\n<p>Medical patients 21 and older can purchase up to <a href=\"https:\/\/abca.dc.gov\/service\/find-medical-cannabis-retailer#:~:text=The%20maximum%20amount%20of%20medical,day%20period%20is\">eight ounces of cannabis flower<\/a>, <a href=\"https:\/\/abca.dc.gov\/service\/find-medical-cannabis-retailer#:~:text=,of%20600%2C000%20mg%20of%20THC\">240 grams of concentrates, or medical cannabis in any form containing a combined total of 600,000 mg of THC. Medical patients between 18 and 20 can purchase up to 60 grams of concentrates.<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Possession limits<\/h3>\n\n\n\n<p>Both adults 21 and over and medical patients <a href=\"https:\/\/mpdc.dc.gov\/marijuana#:\">can possess up to two ounces of cannabis<\/a> and may gift up to one ounce to another adult as long as no payment is involved. Possessing more than two ounces is a criminal offense.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Home cultivation<\/h3>\n\n\n\n<p>Each adult can grow up to six cannabis plants at home and have up to three mature plants at a time. Washington caps the total number of plants per household at 12, with a maximum of six mature plants.&nbsp;<\/p>\n\n\n\n<p>Home-grown <a href=\"https:\/\/code.dccouncil.gov\/us\/dc\/council\/code\/sections\/48-904.01\">cannabis may be gifted (up to one ounce), but home growers cannot sell their weed<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Basic consumption rules<\/h3>\n\n\n\n<p>Weed consumption in Washington is only permitted on private property. The district bans all smoking, eating, or vaping of cannabis in any public place or vehicle. Property owners, like landlords and hotels, also have the right to ban cannabis use on their premises.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u201cGifting\u201d shops<\/h3>\n\n\n\n<p>Unlicensed gifting shops, businesses that exchange cannabis as a \u201cgift\u201d with purchases of other items, are illegal. Washington regulators and police are <a href=\"https:\/\/abca.dc.gov\/release\/abca-mpd-padlock-50th-illegal-cannabis-shop\">actively shutting down these operations<\/a>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"cannabis-purchase-sales-and-consumption-in-washington-d-c\">\n\tCannabis purchase, sales, and consumption in Washington, D.C.<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">The legal path to cannabis in Washington, D.C.<\/h3>\n\n\n\n<p>The medical marijuana program is the only legal way to purchase cannabis in Washington. All legal district dispensaries operate under medical licenses from the <a href=\"https:\/\/abca.dc.gov\/\">Alcoholic Beverage and Cannabis Administration<\/a> (ABCA) and may only sell to registered patients. Fortunately, the program is very accessible to both locals and visitors.&nbsp;<\/p>\n\n\n\n<p>Any adult who wants to buy cannabis in Washington can do so by registering as a medical marijuana patient.<\/p>\n\n\n\n<p>Washington residents aged 21 and older can <a href=\"https:\/\/octo.quickbase.com\/db\/bscn22va8?a=dbpage&amp;pageID=23\">self-certify to obtain a medical card<\/a>, without requiring a doctor's visit. (<a href=\"https:\/\/octo.quickbase.com\/db\/bscn22va8?a=dbpage&amp;pageID=39\">Non-residents can apply here<\/a>.)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Why you can't buy recreational cannabis in Washington, D.C.<\/h3>\n\n\n\n<p>In 2014, Washington voters approved <a href=\"https:\/\/mayor.dc.gov\/sites\/default\/files\/dc\/sites\/mayormb\/release_content\/attachments\/I-71Factsheet.pdf\">Initiative 71<\/a> to <a href=\"https:\/\/code.dccouncil.gov\/us\/dc\/council\/code\/sections\/48-904.01\">legalize personal cannabis use and home cultivation<\/a>, but not sales. Shortly afterward, <a href=\"https:\/\/www.congress.gov\/crs-product\/LSB11188\">Congress enacted the Harris Rider<\/a>, a federal restriction to prevent Washington from licensing or taxing adult-use marijuana sales. This federal restriction, renewed each year since 2015, is why recreational dispensaries cannot operate in Washington.&nbsp;<\/p>\n\n\n\n<p>In short, adults may possess and use cannabis recreationally, but <a href=\"https:\/\/mpdc.dc.gov\/marijuana\">any attempt to sell it commercially is illegal<\/a>. Unless and until Congress removes the Harris Rider, medical dispensaries remain the only legal<strong> <\/strong>source of cannabis in Washington<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Washington's gifting gray market explained<\/h3>\n\n\n\n<p>Banning recreational sales through the Harris Rider led to an unregulated gifting market that proliferated across Washington. <a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2023\/04\/19\/i-71-cannabis-gifting-washington-dc\/\">Businesses would sell something like a sticker or a key chain<\/a>, then give \u201cfree\u201d cannabis with the purchase. It's illegal since it's essentially a sale in disguise. Earlier this year, Washington authorities began actively shutting down these businesses (<a href=\"https:\/\/abca.dc.gov\/release\/abca-mpd-padlock-50th-illegal-cannabis-shop#:~:text=Today%2C%20April%2024%2C%202025%2C%20the,cannabis%20shop%20closure%20in%20DC\">over 50 shut down through April 2025<\/a>).&nbsp;<\/p>\n\n\n\n<p>Avoid any <a href=\"https:\/\/www.axios.com\/local\/washington-dc\/2024\/09\/04\/weed-medical-marijuana-gifting-shops-initiative-71\">so-called \u201cI-71\u201d gifting shops<\/a>. To stay safe and compliant, purchase only from licensed dispensaries, as unlicensed products lack testing and quality oversight.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Where you can consume cannabis in Washington, D.C.<\/h3>\n\n\n\n<p>Cannabis use in Washington is restricted to private residences. You may consume on private property, such as at your home or a friend's place.&nbsp;<\/p>\n\n\n\n<p>It is <a href=\"https:\/\/mpdc.dc.gov\/marijuana#:~:text=,which%20the%20public%20is%20invited\">illegal to consume marijuana in any public space<\/a>, which includes streets, sidewalks, parks, outdoor dining areas, bars, or anywhere the public is invited. Avoid using weed in a vehicle, even if you're a passenger. Violating the public use ban can result in arrest or fines.<\/p>\n\n\n\n<p>Importantly, federal property within Washington is completely off-limits for cannabis. <a href=\"https:\/\/mpdc.dc.gov\/marijuana#:~:text=,enforcement%20agencies\">Much of the district is federal land<\/a>, including the National Mall, Capitol grounds, federal buildings, and national parks. Federal law still classifies marijuana as illegal, and federal law enforcement agencies can arrest anyone for possession or use of cannabis on federal property.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Possession limits<\/h3>\n\n\n\n<p>Washington law allows adult users 21 and over to <a href=\"https:\/\/mpdc.dc.gov\/marijuana#:~:text=As%20a%20result%2C%20it%20is,least%2021%20years%20old%20to\">possess up to two ounces of cannabis flower<\/a> on their person. Adults may also share up to one ounce with another adult 21 or older, as long as no money, goods, or services change hands in exchange for the weed.<\/p>\n\n\n\n<p>Despite the greater purchase limits for medical patients, a medical patient, like any adult, may only possess up to two ounces on their person in public.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"growing-cannabis-in-washington-d-c\">\n\tGrowing cannabis in Washington, D.C.<\/h2>\n\n\n\n<p>District law permits home cultivation of cannabis for personal use. Adults 21 and older can <a href=\"https:\/\/code.dccouncil.gov\/us\/dc\/council\/code\/sections\/48-904.01\">grow up to six marijuana plants<\/a> at their primary residence, with no more than three in the mature (flowering) stage at any time. If multiple adults live in the same household, they can grow up to 12 plants total, with a maximum of six mature plants, per residence. These plants must be grown indoors at a private residence.<\/p>\n\n\n\n<p>All home-grown cannabis is for personal use only. Selling home-grown weed is illegal, but adults can legally <a href=\"https:\/\/code.dccouncil.gov\/us\/dc\/council\/code\/sections\/48-904.01\">gift up to one ounce to another adult<\/a>. Just as with other possession rules, avoid carrying more than two ounces when moving your harvest.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"medical-marijuana-in-washington-d-c\">\n\tMedical marijuana in Washington, D.C.<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Who qualifies as a patient?<\/h3>\n\n\n\n<p>Any Washington resident 18 or older can qualify as a medical cannabis patient. Adults 21 and older can self-certify their medical use <a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2023\/04\/19\/buying-cannabis-legally-dc\/#:~:text=Medical%20marijuana%20has%20been%20legal,sign%20up%20in%20person%20at\">without a doctor's recommendation<\/a>, while Washington locals aged 18 to 20 require a doctor's approval. Minors can enroll as patients with a parent or guardian as their registered caregiver.<\/p>\n\n\n\n<p><a href=\"https:\/\/washingtondccannabis.org\/medical-conditions\">There is no set list of qualifying conditions<\/a>.<\/p>\n\n\n\n<p>Non-residents from eligible <a href=\"https:\/\/abca.dc.gov\/node\/1626021#gsc.tab=0\">jurisdictions<\/a> can use their home state's medical cards at Washington dispensaries, thanks to the state's reciprocity policy. If you don't have a card, Washington allows visitors to obtain a temporary medical registration during their stay.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">How to get a medical marijuana card in D.C.<\/h3>\n\n\n\n<p>Obtaining a medical marijuana card in Washington is very straightforward.&nbsp;<\/p>\n\n\n\n<p>If you're 21 or older:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You can <a href=\"https:\/\/octo.quickbase.com\/db\/bscn22va8?a=dbpage&amp;pageID=23\">apply online through the ABCA portal and self-certify<\/a> your need for medical cannabis without going to the doctor<\/li>\n\n\n\n<li>Provide proof of Washington residency (like a driver's license or ID) and a passport-style photo&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/abca.dc.gov\/release\/abca-mpd-padlock-50th-illegal-cannabis-shop#:~:text=All%20of%20DC%E2%80%99s%2058%20licensed,to%20purchase%20immediately%20upon%20registering\">As of 2025, the registration fee has been waived<\/a>. Washington now issues the standard two-year medical card free of charge. After approval, you'll receive a digital card and a physical card by mail.<\/p>\n\n\n\n<p>Non-DC residents can get a <a href=\"https:\/\/abca.dc.gov\/page\/patients-non-dc-residents#gsc.tab=0\">temporary patient registration<\/a> by <a href=\"https:\/\/octo.quickbase.com\/db\/bscn22va8?a=dbpage&amp;pageID=39\">filling out a quick online form<\/a> and paying a fee (takes about 10 minutes to get your digital card), or you can use your existing medical card from another state if DC recognizes it through reciprocity.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Where to buy medical marijuana in D.C.<\/h3>\n\n\n\n<p>Washington allows only licensed medical cannabis dispensaries to sell medical cannabis legally. There are no recreational dispensaries, meaning medical retailers serve the entire market of patients, including self-certified adults.&nbsp;<\/p>\n\n\n\n<p>As of 2025, Washington has dozens of dispensaries across the city \u2013 the number of licensed retailers expanded to <a href=\"https:\/\/weedmaps.com\/dispensaries\/in\/united-states\/dc\">over 50 as of Fall 2025<\/a>.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/weedmaps.com\/dispensaries\/in\/united-states\/district-of-columbia\/washington?amenities%5B%5D=is_medical\">Washington<\/a> medical <a href=\"https:\/\/weedmaps.com\/dispensaries\/in\/united-states\/district-of-columbia\/washington?amenities%5B%5D=is_medical\">dispensaries<\/a> can operate between 7 a.m. and 11 p.m., though hours vary by location.<\/p>\n\n\n\n<p>When you arrive at a dispensary, you must present a valid government photo ID and your medical marijuana card.
