{"id":3301,"date":"2017-12-17T10:06:25","date_gmt":"2017-12-17T10:06:25","guid":{"rendered":"https:\/\/weedmaps.com\/learn\/laws-and-regulations\/germany"},"modified":"2024-08-20T13:42:39","modified_gmt":"2024-08-20T13:42:39","slug":"germany","status":"publish","type":"law","link":"https:\/\/weedmaps.com\/learn\/laws-and-regulations\/germany","title":{"rendered":"Germany"},"content":{"rendered":"<div id=\"bsf_rt_marker\"><\/div>\n<h2 class=\"wm-article-table-of-contents-header\" id=\"is-weed-legal-in-germany\">\n\tIs weed legal in Germany?<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">\u201cDas Gras,\u201d the German word for weed, has undergone some legislative changes in recent years.<\/span> <span style=\"font-weight: 400\">Germany marijuana laws<\/span><span style=\"font-weight: 400\"> were modified on March 10, 2017, when the country legalized the prescription of cannabis to seriously ill patients even if other treatment options are available.&nbsp; An <\/span><a href=\"https:\/\/www.bgbl.de\/xaver\/bgbl\/start.xav?startbk=Bundesanzeiger_BGBl&amp;jumpTo=bgbl117s0403.pdf#__bgbl__%2F%2F*%5B%40attr_id%3D%27bgbl117s0403.pdf%27%5D__1552427359726\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">amendment<\/span><\/a><span style=\"font-weight: 400\"> to the <\/span><a href=\"https:\/\/www.bundesgesundheitsministerium.de\/fileadmin\/Dateien\/3_Downloads\/Gesetze_und_Verordnungen\/GuV\/N\/Narcotic_Drugs_18_12_2009.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Narcotics Drugs Act<\/span><\/a><span style=\"font-weight: 400\"> (<\/span><a href=\"https:\/\/www.gesetze-im-internet.de\/btmg_1981\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Bet\u00e4ubungsmittelgesetz<\/span><\/a><span style=\"font-weight: 400\">) enacted the change, which also includes covering the cost of treatment through patients' health insurance. Legalization of medical use is the first movement on cannabis since a <\/span><a href=\"https:\/\/www.nytimes.com\/1994\/05\/03\/world\/german-court-allows-possession-of-small-amounts-of-marijuana.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">1994 court ruling<\/span><\/a><span style=\"font-weight: 400\"> that shifted enforcement away from criminal penalties provided the amount held is \u201csmall,\u201d as specified by individual German states.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"is-weed-legal-in-berlin\">\n\tIs weed legal in Berlin?<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Recreational marijuana is illegal in the city-state of Berlin, but medical marijuana is permitted in accordance with German marijuana laws.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">A survey of the existing medical market at the beginning of 2018 <\/span><a rel=\"noopener noreferrer\" href=\"https:\/\/www.thelocal.de\/20180110\/medical-marijuana-in-high-demand-with-over-13000-applications-report\" target=\"_blank\"><span style=\"font-weight: 400\">reported 13,000 applications<\/span><\/a><span style=\"font-weight: 400\"> were submitted by patients after the medical-use legislation went into effect in March 2017.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Most recently, Germany opened applications for cultivators and <\/span><a href=\"https:\/\/mjbizdaily.com\/79-applications-13-contracts-cultivate-medical-cannabis-germany\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">will select a maximum of 13 companies<\/span><\/a><span style=\"font-weight: 400\"> to provide a steady supply for the medical German market.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"regulatory-authority\">\n\tRegulatory authority<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">The Federal Institute for Drugs and Medical Devices created a cannabis agency pursuant to the United Nations Single Convention on Narcotic Drugs of 1961, which states that \u201ca member state must establish or appoint such a public agency as soon as cannabis is intended to be cultivated in the state in question for non-industrial uses\u201d Werner Kn\u00f6ss, Ph.D., is the appointed head of Germany's Cannabis Agency within the Federal Institute for Drugs and Medical Devices.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Main Regulatory Body: <\/span><a href=\"https:\/\/www.bfarm.de\/EN\/Home\/home_node.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Federal Institute for Drugs and Medical Devices&nbsp;<\/span><\/a><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Subbody:<\/span><a href=\"https:\/\/www.bfarm.de\/EN\/Service\/ContactPersons\/FederalOpiumAgency\/_node.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\"> Federal Opium Agency&nbsp;<\/span><\/a><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Contact for <\/span><a rel=\"noopener noreferrer\" href=\"https:\/\/www.bfarm.de\/EN\/Service\/ContactPersons\/FederalOpiumAgency\/_node.html\" target=\"_blank\"><span style=\"font-weight: 400\">\u201cExceptional licenses to purchase cannabis for medical purposes\u201d<\/span><\/a><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"possession\">\n\tPossession<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Adult use is not legal, though consumption is technically not criminal.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"medical-marijuana-in-germany\">\n\tMedical marijuana in Germany<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Medical marijuana is prescribed by physicians to seriously ill patients and distributed through pharmacies. No special permit is required to obtain medical marijuana in Germany.
