Possession of 21 grams of cannabis or cannabis-infused products with no more than 300 milligrams of THC, or up to 5 grams of hash can be punished with a fine up to $100 for a first and second offense. A third offense within three years could bring a $300 fine.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"legalization-history\">\n\tLegalization history<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">New Hampshire became the 19th state in the nation and the last in New England to allow medical marijuana in 2013 when it passed <\/span><a rel=\"noopener noreferrer\" href=\"https:\/\/www.gencourt.state.nh.us\/legislation\/2013\/HB0573.html\" target=\"_blank\"><span style=\"font-weight: 400\">House Bill 573.<\/span><\/a><span style=\"font-weight: 400\"> The law established a list of qualifying conditions, albeit restrictive. Under the law, not only did a patient need a diagnosis of a qualifying condition, but they also had to exhibit severe symptoms of the debilitating condition.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">HB 573 required dispensaries to be nonprofit and set requirements for medical marijuana cards and purchase and possession limits. The original law also did not allow for home growing.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">In 2014, the New Hampshire House of Representatives approved a marijuana legalization bill, but it later died in the Senate<\/span>.<span style=\"font-weight: 400\">&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">New Hampshire decriminalized marijuana in 2017. Possession of cannabis of 0.75 ounce or less became a civil offense punishable with a $100 fine for a first or second offense and $300 for a third offense<\/span>.<\/p>\n\n\n\n<p><span style=\"font-weight: 400\">New legalization attempts may face an uphill battle after the November 2020 election since Gov. Chris Sununu, an opponent, was re-elected and few supporters remained in the legislature.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"where-is-it-safe-to-purchase-weed-in-new-hampshire\">\n\tWhere is it safe to purchase weed in New Hampshire?<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Medical cannabis is overseen and regulated by the <\/span><a rel=\"noopener noreferrer\" href=\"https:\/\/www.dhhs.nh.gov\/oos\/tcp\/\" target=\"_blank\"><span style=\"font-weight: 400\">Therapeutic Cannabis Program<\/span><\/a><span style=\"font-weight: 400\"> of the Department of Health and Human Services. Registered patients can purchase medical marijuana at one of the state's dispensaries, called Alternative Treatment Centers (ATCs). Patients can only shop at the ATC they chose during registration. Delivery is not available.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Patients can purchase no more than 2 ounces of marijuana or marijuana products within a 10-day period and may not possess more than that amount. Patients and caregivers between them can't possess more than 2 ounces at a time.&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Find licensed dispensaries in New Hampshire<\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Medical marijuana cardholders can <\/span><a href=\"https:\/\/weedmaps.com\/listings\/in\/united-states\/new-hampshire\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">find licensed dispensaries in New Hampshire<\/span><\/a><span style=\"font-weight: 400\"> and search by major metro areas. Many dispensaries in New Hampshire offer curbside pickup services in addition to storefront sales.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"where-is-it-safe-to-consume-cannabis\">\n\tWhere is it safe to consume cannabis?<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">In New Hampshire, marijuana cannot be consumed in public. In addition, it is illegal to possess medical marijuana in school buildings or on school grounds, at public recreation and youth centers, or at a place of employment without the employer's written permission.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"medical-marijuana-in-new-hampshire\">\n\tMedical marijuana in New Hampshire <\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">New Hampshire's Department of Health and Human Services oversees the <\/span><a href=\"https:\/\/www.dhhs.nh.gov\/oos\/tcp\/qualifying-patient.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Therapeutic Cannabis Program<\/span><\/a><span style=\"font-weight: 400\"> (TCP). New Hampshire residents 18 years or older can <\/span><a href=\"https:\/\/www.dhhs.nh.gov\/oos\/tcp\/documents\/applicationpatient.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">complete an application<\/span><\/a><span style=\"font-weight: 400\"> once they've received a Written Certification for the Therapeutic Use of Cannabis from a qualified medical professional. The patient and provider must have an ongoing relationship of at least three months (though there are some exceptions). Parents or guardians can apply for minor patients.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Qualifying conditions<\/strong><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">New Hampshire recognizes the following conditions:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Alzheimer's disease<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Amyotrophic lateral sclerosis (ALS), or Lou Gehrig's disease<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Cancer<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Chronic pancreatitis<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Crohn's disease<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Ehlers-Danlos syndrome<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Epilepsy<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Glaucoma<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Hepatitis C<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">HIV\/AIDS<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Lupus<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Multiple sclerosis<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Muscular dystrophy<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Parkinson's disease<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Spinal cord injury or disease<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Traumatic brain injury<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Ulcerative colitis<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Additionally, the condition must be severely debilitating or terminal, or its treatment has produced at least one of the following symptoms:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Agitation of Alzheimer's disease<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Cachexia, or wasting syndrome<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Chemotherapy-induced anorexia<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Constant or severe nausea<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Elevated intraocular pressure, or glaucoma<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Moderate to severe vomiting<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Seizures<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Severe, persistent muscle spasms<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Severe pain that has not responded to previously prescribed medication or surgical measures, or for which other treatment options produce serious side effects<\/span><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Registry process<\/strong><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Patients must visit a doctor, doctor's assistant, or advanced practice registered nurse (APRN) licensed in New Hampshire or a doctor or APRN licensed in Maine, Massachusetts, or Vermont to be diagnosed with a qualifying condition and receive a written certification. Patients can then visit <\/span><a href=\"https:\/\/www.dhhs.nh.gov\/oos\/tcp\/documents\/applicationpatient.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">the TCP website<\/span><\/a><span style=\"font-weight: 400\"> to register.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Applications must include:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Written Certification for the Therapeutic Use of Cannabis from the patient's physician<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">State-issued ID or other proof of New Hampshire residency<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">$50 application fee<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">A patient may designate a caregiver at any time. The designated caregiver must be 21 years or older and never convicted of a felony. They must <\/span><a href=\"https:\/\/www.dhhs.nh.gov\/oos\/tcp\/documents\/applicationcaregiver.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">complete an application<\/span><\/a><span style=\"font-weight: 400\"> and a background check to be approved by the TCP. The caregiver must have a Caregiver Registry ID card before assisting the patient.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"reciprocity\">\n\tReciprocity<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">While medical marijuana patients from other states are not allowed to purchase from ATCs, they can legally possess cannabis as long as they have a condition on New Hampshire's list of qualifying conditions.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"lab-testing\">\n\tLab testing<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">New Hampshire medical marijuana laws require that each batch of cannabis be tested by a state-licensed lab.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Labs must test for:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Cannabinoid profile and potency<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Chemicals<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Heavy metals<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Microbes<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Mycotoxins<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Pesticides<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Residual solvents (for concentrates only)<\/span><\/li><\/ul>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"frequently-asked-questions\">\n\tFrequently asked questions<\/h2>\n\n\n\n<h4 class=\"wp-block-heading\"><b>When will New Hampshire decriminalize weed?&nbsp;<\/b><\/h4>\n\n\n\n<p><span style=\"font-weight: 400\">New Hampshire decriminalized weed in 2017.
