As of August 1, 2023, <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/342.09\">Minnesota legalized adult-use recreational marijuana<\/a>, making it the 23rd state to do so. Medical marijuana has been legal since May 2014 in the North Star State.<\/p>\n\n\n\n<p>You need to be at least 21 years old to buy and consume recreational marijuana from a dispensary, much like you would alcohol.<\/p>\n\n\n\n<p>For medical marijuana, you need to be 18 or older to buy and consume. For medical patients under 18, a parent or legal guardian designated as a caregiver can purchase medical marijuana from licensed dispensaries on behalf of the minor.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/342.42\">Weed delivery is legal in Minnesota<\/a> for recreational and medical cannabis, too.<\/p>\n\n\n\n<p><em>Find <a href=\"https:\/\/weedmaps.com\/dispensaries\/in\/united-states\/minnesota\">weed dispensaries in Minnesota<\/a> or order <a href=\"https:\/\/weedmaps.com\/deliveries\/in\/united-states\/minnesota\">weed delivery<\/a> from local retailers on Weedmaps.<\/em><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"quick-facts-minnesota-marijuana-laws\">\n\tQuick facts: Minnesota marijuana laws<\/h2>\n\n\n\n<p><strong>Purchase and possession limits<\/strong><\/p>\n\n\n\n<p><strong>For recreational users:<\/strong> Adults 21 and older may purchase and possess up to 2 ounces of cannabis flower in public, up to 2 pounds of cannabis flower in their private residence, up to 8 grams of cannabis concentrate, and edibles with up to 800 milligrams of THC.<\/p>\n\n\n\n<p><strong>For medical patients:<\/strong> Certified medical cannabis patients can purchase up to a 30-day supply of cannabis products in a 23-day period from a state-licensed dispensary, not to exceed 450 grams of dried cannabis flower per visit, with a 90-day supply maximum.<\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"legislation-history\">\n\tLegislation history <\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Gov. Mark Dayton signed the <\/span><a href=\"https:\/\/www.revisor.mn.gov\/laws\/2014\/0\/311\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Minnesota Medical Cannabis Act<\/span><\/a><span style=\"font-weight: 400\"> into law in May 2014. Minnesota was the 23rd state to enact medical marijuana legislation. The law created the state's <\/span><a href=\"https:\/\/www.health.state.mn.us\/people\/cannabis\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Medical Cannabis Program and Registry<\/span><\/a><span style=\"font-weight: 400\"> under the auspices of the Minnesota Department of Health (MDH). Sales began in 2018.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"where-is-it-safe-to-purchase-weed-in-minnesota\">\n\tWhere is it safe to purchase weed in Minnesota?<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Minnesota patients may purchase cannabis medicine at <\/span><a href=\"https:\/\/www.health.state.mn.us\/people\/cannabis\/patients\/locations.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">state-approved dispensaries<\/span><\/a><span style=\"font-weight: 400\">. It's available as:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">Capsules<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Liquid, including oil<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Lozenges<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Oral sprays<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Pills<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Tablets<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Tinctures<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Topicals<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Vaporization cartridges<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Vaporization devices (vape pens) are also available.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">At the dispensary, patients need to provide a summary of their doctor visit and a list of prescribed medications. These will be given to them by the certifying health-care provider. They must fill out a self-evaluation form in-store if they haven't already completed it online. After reviewing these items, the on-site pharmacist will recommend a cannabis dosage for the patient.&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Finding licensed dispensaries in Minnesota<\/strong><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Registered patients can <\/span><a href=\"https:\/\/weedmaps.com\/listings\/in\/united-states\/minnesota\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">find licensed dispensaries in Minnesota<\/span><\/a><span style=\"font-weight: 400\"> and search by cities including Minneapolis, Rochester, and Fargo. Delivery remains illegal but many dispensaries in Minnesota offer curbside pickup services in addition to storefront sales.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"where-is-it-safe-to-consume-cannabis\">\n\tWhere is it safe to consume cannabis?<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Most of the legal forms of medical cannabis are taken orally so consumption shouldn't be much of an issue. Nonetheless, Minnesota law states that patients can't do anything while under the influence of medical cannabis that would be considered negligent or lead to professional malpractice.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">It forbids possessing or consuming cannabis medicine while operating a vehicle or while on a school bus or school grounds, in a correctional facility, or on the grounds of any child-care facility.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Vaping medical cannabis is forbidden in any public place, including public transportation, or where the vapor could be inhaled by a minor.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"possessing-cannabis\">\n\tPossessing cannabis <\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Registered and certified medical marijuana patients and their caregivers can legally possess a <\/span><a href=\"https:\/\/www.revisor.mn.gov\/laws\/2014\/0\/311\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">30-day supply<\/span><\/a><span style=\"font-weight: 400\"> of cannabis at the dosage determined by the pharmacist.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">For those who aren't registered medical marijuana patients, possession of less than 42.5 grams (1.5 ounces) of cannabis is considered a petty misdemeanor. First-time offenders may be ordered to attend drug rehab, though the law does allow a fine of up to $300. Possessing more than 42.5 grams of cannabis is considered a felony.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"medical-cannabis-program\">\n\tMedical cannabis program<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">The Minnesota Department of Health's Office of Medical Cannabis oversees <\/span><a href=\"https:\/\/www.health.state.mn.us\/people\/cannabis\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">the Medical Cannabis Program<\/span><\/a><span style=\"font-weight: 400\">. The program maintains the patient, caregiver, and health-care practitioners registries and promulgates program rules.&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Qualifying conditions<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">Alzheimer's disease<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Amyotrophic lateral sclerosis (ALS), or Lou Gehrig's disease<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Autism<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Cachexia, or wasting disease<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Cancer, if the underlying condition or treatment causes severe or chronic pain, nausea, or severe vomiting<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Chronic or intractable pain<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Glaucoma<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">HIV\/AIDS<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Inflammatory bowel disease, including Crohn's disease<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Obstructive sleep apnea<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Post-traumatic stress disorder (PTSD)<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Seizures, including epilepsy<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Severe and persistent muscle spasms, including multiple sclerosis<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Terminal illness with a probable life expectancy of less than a year if the illness or its treatment causes cachexia (severe wasting disease), nausea, or severe vomiting<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Minnesotans can <\/span><a href=\"https:\/\/www.health.state.mn.us\/people\/cannabis\/rulemaking\/addconditions.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">petition the Medical Cannabis Program<\/span><\/a><span style=\"font-weight: 400\"> to add new conditions.&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Patient application process<\/strong><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">To receive medical marijuana, patients must enroll in the Medical Cannabis Registry and complete the application process.<\/span><\/p>\n\n\n\n<p><strong>Patients must:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">Visit a doctor, physician's assistant, or advanced practice registered nurse<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Receive a diagnosis of one or more of the qualifying conditions<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Talk to the practitioner about adding a caregiver, if applicable<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Give the health-care practitioner their email address<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Request a visit summary with medications and medical conditions<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Check their email for confirmation of certification and a registration link<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Register online providing:<\/span>\n<ol class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">Government-issued ID<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">$200 registration payment<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Proof of eligibility for discount fee, if applicable<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Caregiver's information, if applicable<\/span><\/li>\n<\/ol>\n<\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Complete self-evaluation report (must be done before each purchase)<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Go to a Cannabis Patient Center to visit with a pharmacist and purchase cannabis medication<\/span><\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Caregivers<\/strong><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">During the certification process, patients can also ask to designate a parent, legal guardian, or another person as a <\/span><a href=\"https:\/\/www.health.state.mn.us\/topics\/cannabis\/caregivers\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">caregiver to administer cannabis<\/span><\/a><span style=\"font-weight: 400\"> and acquire it at dispensaries, if patients are disabled. The health-care practitioners must approve the caregiver. Once the practitioner has approved the caregiver, parents, guardians, or spouses can register themselves.
