{"id":3221,"date":"2017-12-17T09:52:10","date_gmt":"2017-12-17T09:52:10","guid":{"rendered":"https:\/\/weedmaps.com\/learn\/laws-and-regulations\/massachusetts"},"modified":"2025-11-26T18:32:41","modified_gmt":"2025-11-26T18:32:41","slug":"massachusetts","status":"publish","type":"law","link":"https:\/\/weedmaps.com\/learn\/laws-and-regulations\/massachusetts","title":{"rendered":"Massachusetts Weed Laws"},"content":{"rendered":"<div id=\"bsf_rt_marker\"><\/div>\n<h2 class=\"wm-article-table-of-contents-header\" id=\"is-weed-legal-in-massachusetts\">\n\tIs weed legal in Massachusetts?<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Yes, both medical and recreational, i.e. adult-use, marijuana are legal in the Pilgrim State.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Possession of more than 1 ounce but not more than 2 ounces outside the home is a misdemeanor with a <\/span><a href=\"https:\/\/malegislature.gov\/Laws\/GeneralLaws\/PartI\/TitleXV\/Chapter94G\/Section13\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">potential penalty<\/span><\/a><span style=\"font-weight: 400\"> of a $100 fine and forfeiture of the cannabis in excess of 1 ounce.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"legislation-history\">\n\tLegislation history<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Voters approved the Massachusetts Medical Marijuana Ballot Initiative, or <\/span><a rel=\"noopener noreferrer\" href=\"https:\/\/www.sec.state.ma.us\/ele\/elepdf\/IFV-2012.pdf\" target=\"_blank\"><span style=\"font-weight: 400\">Question 3<\/span><\/a><span style=\"font-weight: 400\">, in November 2012. Question 3 established the Massachusetts Medical Use of Marijuana Program, initially administered by the <\/span><a rel=\"noopener noreferrer\" href=\"https:\/\/www.mass.gov\/orgs\/department-of-public-health\" target=\"_blank\"><span style=\"font-weight: 400\">Massachusetts Department of Public Health<\/span><\/a><span style=\"font-weight: 400\"> (DPH), to regulate medical marijuana across the Commonwealth.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The Massachusetts Marijuana Legalization Initiative, or <\/span><a href=\"https:\/\/ballotpedia.org\/Massachusetts_Marijuana_Legalization,_Question_4_(2016)\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Question 4<\/span><\/a><span style=\"font-weight: 400\">, passed by voters in November 2016, legalized cannabis use for adults 21 and older and created the <\/span><a href=\"https:\/\/mass-cannabis-control.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Cannabis Control Commission<\/span><\/a><span style=\"font-weight: 400\"> (the Commission) to regulate marijuana statewide. Retail sales began in November 2018.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">When it was time for legislators to enact Question 4 into law, the two houses had differing approaches but a compromise bill was eventually approved. <\/span><a href=\"https:\/\/malegislature.gov\/Bills\/190\/H3818.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">H 3818<\/span><\/a><span style=\"font-weight: 400\"> was signed by Gov. Charlie Baker in July 2017 and became <\/span><a href=\"https:\/\/malegislature.gov\/Laws\/SessionLaws\/Acts\/2017\/Chapter55\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Chapter 55<\/span><\/a><span style=\"font-weight: 400\"> of the General Laws of the Commonwealth of Massachusetts.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The bill added two more members to the Commission and made the marijuana excise tax 10.75% on top of the state sales tax of 6.25% while also allowing cities to add 3%, for a total of 20% tax on adult-use marijuana. Medical cannabis remained tax-free. The bill also allowed jurisdictions that had voted against legalization to ban retail sales with a vote of the city council while jurisdictions that voted for it would need a referendum to ban sales.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"where-is-it-safe-to-purchase-weed-in-massachusetts\">\n\tWhere is it safe to purchase weed in Massachusetts?<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Medical marijuana<\/strong><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Registered patients can purchase a 60-day supply of medical cannabis from any state-licensed dispensary. The 60-day supply is limited to 10 ounces, though the certifying health care provider can specify more on the patient's certificate. There are medical marijuana delivery services available, and a designated caregiver may transport medical cannabis from a licensed dispensary or grow site to a registered patient. Medical marijuana is tax-exempt in Massachusetts.&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Adult-use<\/strong><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Adults age 21 and older can purchase 1 ounce of cannabis or 5 grams of concentrate from licensed marijuana retailers. Adult-use cannabis is subject to a 6.25% sales tax, a 10.75% state excise tax, and a potential municipal tax of up to 3%. As such, most adult-use consumers could encounter a total tax rate of about 20%.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Finding licensed dispensaries in Massachusetts<\/strong><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Registered patients can <\/span><a href=\"https:\/\/weedmaps.com\/listings\/in\/united-states\/massachusetts\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">find licensed dispensaries in Massachusetts<\/span><\/a><span style=\"font-weight: 400\"> and search by cities including Boston, Worcester, and North Hampton. Many dispensaries in Massachusetts offer delivery and curbside pickup services in addition to storefront sales.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"where-is-it-safe-to-consume-cannabis\">\n\tWhere is it safe to consume cannabis?<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Cannabis can be consumed on private property, but marijuana products cannot be smoked, eaten, or vaped in public. Furthermore, cannabis products cannot be smoked where tobacco smoking is prohibited. Adult-use consumers as well as registered patients and their caregivers can carry cannabis in their vehicles as long as it is in a sealed container in the trunk or a locked glove compartment.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Driving under the influence of cannabis is illegal. Neither drivers nor passengers may consume marijuana in a vehicle. Consumption is generally banned in public but the Commission does allow local jurisdictions to set their own rules around cafes, smoke rooms, or other options for social consumption.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The Commission offers a fact sheet on <\/span><a href=\"https:\/\/mass-cannabis-control.com\/wp-content\/uploads\/2018\/06\/Fact-Sheet-Consumption.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">adult consumption in Massachusetts<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"possessing-cannabis\">\n\tPossessing cannabis <\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Adults 21 and older, as well as patients and their caregivers, are allowed to possess 10 ounces (283 grams) of cannabis inside their homes, and less than 1 ounce (28 grams) in public. <\/span>Medical patients can possess a 60-day supply of cannabis concentrates and adults can possess up to 1 ounce of concentrates in public or 1.5 ounces at home.<span style=\"font-weight: 400\"> <\/span><a rel=\"noopener noreferrer\" href=\"https:\/\/mass-cannabis-control.com\/wp-content\/uploads\/2018\/04\/Guidance-Home-Cultivation.pdf\" target=\"_blank\"><span style=\"font-weight: 400\">Adults are also allowed to grow<\/span><\/a><span style=\"font-weight: 400\"> up to six cannabis plants per person and up to 12 per household in their homes.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">While medical and adult-use cannabis are now legal in Massachusetts, both patients and consumers still face penalties for violating <\/span><a href=\"https:\/\/mass-cannabis-control.com\/wp-content\/uploads\/200825_Guidance_for_Consumption_of_Marijuana_for_Adult_Use.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">what is allowable under state law<\/span><\/a><span style=\"font-weight: 400\">. Specifically, public consumption of cannabis or smoking it where smoking tobacco is prohibited can result in a fine of $100, and possessing an open container of cannabis in a vehicle can result in a fine of $500.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"is-home-cultivation-allowed-in-massachusetts\">\n\tIs home cultivation allowed in Massachusetts?<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Any individual 21 years of age and older may grow up to six plants per person or up to 12 plants per household in their home. Cannabis from home cultivation doesn't count towards the 10 ounces people are allowed to possess at home. The Commission offers guidelines on <\/span><a rel=\"noopener noreferrer\" href=\"https:\/\/mass-cannabis-control.com\/wp-content\/uploads\/2018\/04\/Guidance-Home-Cultivation.pdf\" target=\"_blank\"><span style=\"font-weight: 400\">growing cannabis at home<\/span><\/a><span style=\"font-weight: 400\"> in compliance with the law.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Qualifying patients may apply for hardship registration if they wish to cultivate their own cannabis, or have a caregiver grow on their behalf. They are allowed to cultivate the number of plants needed to provide a 60-day supply of cannabis.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"medical-marijuana-registry\">\n\tMedical marijuana registry<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Qualified patients can register with the <\/span><a href=\"https:\/\/www.mass.gov\/patients-of-the-medical-use-of-marijuana-program\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Medical Use of Marijuana Program<\/span><\/a><span style=\"font-weight: 400\"> (MMP) to access cannabis for medical use. Patients must meet with and receive certification from a health-care provider before they can register for the MMP. Registration must be renewed annually by both patients and caregivers, though registry ID cards are good for three years. Patients must also maintain active certifications from their original health-care providers. There's no charge for patients or caregivers to register with MMP.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Qualifying conditions<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Amyotrophic lateral sclerosis (ALS), or Lou Gehrig's disease<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Cancer<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Crohn's disease<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Glaucoma<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Hepatitis C<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">HIV\/AIDS<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Multiple sclerosis<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Parkinson's disease<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Any other condition considered debilitating by the patient's health-care provider may be a qualifying condition.&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Application process<\/strong><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Obtain a physician's certification that confirms the patient suffers from at least one qualifying medical condition.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Receive from the physician a personal identification number (PIN) needed to register with the program.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Provide a valid state-issued identification card to establish proof of Massachusetts residency, as well as a recent photo that conforms to <\/span><a href=\"https:\/\/www.mass.gov\/doc\/patient-guidance-for-mmj-registration-2\/download\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">registration guidelines<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Designate a caregiver, if applicable.<\/span><\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Caregiver requirements<\/strong><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Registered patients who require assistance obtaining or using medical marijuana may designate a <\/span><a href=\"https:\/\/www.mass.gov\/caregivers-of-the-medical-use-of-marijuana-program\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">primary caregiver<\/span><\/a><span style=\"font-weight: 400\">. Prospective personal caregivers must first register with the MMP using the patient's PIN (provided by the physician). Caregivers must be at least 21 years old and may only provide care for one patient. An employee of a hospice, nursing, or medical facility; or a visiting nurse, personal care attendant, or home health aide providing care to a qualifying patient, may serve as a designated caregiver, including to patients younger than 18 as a second caregiver.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Application process<\/strong><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Obtain the patient's PIN via their current MMP portal account.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Complete the program application.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Provide a valid state-issued identification card to establish proof of Massachusetts residency, as well as a recent photo that conforms to <\/span><a href=\"https:\/\/www.mass.gov\/doc\/caregiver-registration-step-by-step-instructions-1\/download\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">registration guidelines<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/li><\/ol>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"reciprocity\">\n\tReciprocity<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Massachusetts does not allow reciprocity for medical marijuana, but adults 21 and older may purchase recreational products whether they are residents or not.<\/span><\/p>\n\n\n\n<h2 class=\"wm-article-table-of-contents-header\" id=\"lab-testing\">\n\tLab testing<\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">The Commission requires that all cannabis harvested for commercial and medical use, as well as all marijuana products, be tested for safety, quality control, and potency.
